Overview
Welcome to Voirelle. "Voirelle", "we", "us" and "our" mean Voirelle, the business that runs voirelle.com and the services on it, including the song quiz, previews, song pages and anything you buy from us (together, the "Services").
These Terms of Service, together with our Refund Policy, Delivery Policy and Privacy Policy, explain your rights and responsibilities when you use the Services. By using the Services or placing an order, you agree to these Terms. If you don't agree, please don't use the Services.
Our store runs on Shopify, which provides the platform we use to sell to you.
1. Who can use Voirelle
You must be at least the age of majority where you live to place an order. If you allow a minor in your care to use the Services on your device, you're responsible for that use.
The information you give us (your name, email, payment details and quiz answers) must be accurate and yours to share. You're responsible for keeping access to your email and song links secure.
2. Our songs
Every Voirelle song is an original song created from your quiz answers. We write the lyrics from your story and produce the song using AI music tools, with our team guiding the process.
Music is personal, and the finished song may differ from what you pictured. That's why you hear a free preview before you pay, and why every song comes with our 30-Day Guarantee (one free fix). Apart from anything we state in writing, we can't promise a song will match your expectations in style, sound or emotional effect.
We may update, pause or stop offering any product, style or feature at any time.
3. Orders, prices and payment
When you place an order, you're offering to buy it. We may accept or decline any order, for example if we suspect fraud or an order breaks these Terms. If we cancel your order, we'll email you and refund anything you paid.
Prices, sales and promotions can change at any time. Some prices, such as the sale price on your preview page, are only offered for a limited time. You pay the price shown at checkout, and it appears in your order confirmation email. Taxes are added where required.
By paying, you confirm you're authorized to use your payment method and that the charges shown at checkout are correct. Orders are for your personal use, not for resale.
4. Delivery
Songs are delivered digitally to the email you give us at checkout, with a link to your private song page. You choose 30-Minute Delivery or 48-Hour Delivery when you unlock your song. Full details are in our Delivery Policy.
A song counts as delivered once it's live on your song page and the link has been emailed to you. Please check that your email address is correct and look in your spam or promotions folder if it doesn't arrive. We can always resend it.
We work to keep song pages and links online, but we can't guarantee any link will be available forever. Please download your song to keep a copy.
5. Cancellations, fixes and refunds
Each song is custom made from your story, so all sales are final once we start creating it. You can cancel for a full refund within 30 minutes of ordering if we haven't started yet. 30-Minute Delivery (rush) orders can't be cancelled. Dissatisfaction or a change of mind doesn't qualify for a refund.
Our 30-Day Guarantee gives you one free fix: one round of small changes (a name, a detail or a line) requested within 30 days of delivery. The 30-Day Guarantee is a free fix, not a refund or money-back guarantee. Anything we got wrong from your quiz answers is fixed free and doesn't use up your free fix. Bigger changes (a new voice, genre, style or language, a full rewrite or a brand-new version) are paid options shown on your song page before you confirm. Add-ons, rush fees and paid changes are non-refundable. If a file doesn't work, we'll fix it or resend it. Duplicate charges are always refunded. All the details are in our Refund Policy.
Please contact us before opening a payment dispute or chargeback. If one is opened, we may share order, quiz and delivery records with the payment provider.
6. Using your song
When you buy a song, you get a personal, non-commercial license to keep it and enjoy it. That means you can:
- Play it for the person it's for, your family and your friends
- Play it at private events like birthdays, anniversaries, weddings and memorials
- Download it, keep it and share it on your personal social media accounts
Without our written permission, you can't:
- Sell, license or resell the song
- Upload it to streaming services (like Spotify or Apple Music) or monetize it on YouTube or elsewhere
- Use it in ads or for any business or commercial purpose
- Claim you wrote or produced it
Voirelle keeps all rights in the music, lyrics and recordings that aren't granted to you here. Because songs are made with AI music tools, copyright rules for them may differ from traditionally recorded music. Want to use your song commercially? Email us and we'll see what we can do.
7. Your story and the details you share
You keep ownership of the stories, names and memories you share with us. You give us permission to use them to create, deliver and improve your song, and to provide customer support.
By sharing details about other people, including names and stories about children, you confirm you have the right to share them. If you share information about a minor, you confirm you're their parent or guardian or have their parent's permission.
We won't publish your song, your story or the recipient's name publicly without your permission. If you send us a reaction video, review or other feedback and tell us we may share it, you allow us to use it, edit it for length and feature it on our site, emails and social media. You can ask us to stop using it at any time.
8. Content we won't make
Please don't use the Services to create songs that are hateful, harassing, threatening, sexually explicit, defamatory, or that impersonate someone or violate someone else's rights. We may decline or cancel any order like this and refund it.
You also agree not to misuse the Services, including by breaking the law, uploading malicious code, scraping or copying the site, interfering with its security, or reselling our Services.
9. Gift codes
Gift codes (Song Credits) can be used toward a song on voirelle.com. They can't be exchanged for cash except as stated in our Refund Policy or where the law requires.
10. Our content
The Voirelle name, logo, website, text, images, videos and audio belong to Voirelle or our licensors. You may not copy or reuse them without our written permission.
11. Third-party tools and links
The Services rely on trusted partners, such as Shopify for our store and checkout, payment processors and email providers. Links to other websites are provided for convenience. We're not responsible for third-party sites or services, and their own terms apply.
12. Mistakes on our site
Sometimes our site may contain errors in descriptions, prices, delivery times or promotions. We may correct them, and cancel affected orders with a full refund, even after you've ordered.
13. Disclaimer
Except as stated in these Terms and our policies, the Services are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise the Services will always be uninterrupted or error-free. Some places don't allow these exclusions, so they may not apply to you.
14. Limitation of liability
To the fullest extent allowed by law, Voirelle and its owners, team, contractors and partners are not liable for any indirect, incidental, special, punitive or consequential damages, or for lost profits, revenue or data, arising from your use of the Services or any product.
To the fullest extent allowed by law, our total liability for any claim about an order will not be more than the amount you paid us for that order. Nothing in these Terms limits liability that can't be limited by law.
15. Indemnity
You agree to cover Voirelle and its owners, team and partners for any third-party claims, losses and reasonable legal fees that come from your breach of these Terms, your violation of any law or someone else's rights, or content you provide to us.
16. Suspension and termination
We may suspend or end your access to the Services if you break these Terms. Sections that by their nature should continue (like Using your song, Disclaimer, Limitation of liability and Indemnity) still apply afterward.
17. Disputes and governing law
If something goes wrong, please email us first at hey@voirelle.com. Most problems are solved quickly that way.
These Terms are governed by the laws of the State of California and applicable United States law, without regard to conflict of law rules. Any dispute that we can't resolve informally will be handled in the state or federal courts located in San Diego County, California, unless the law where you live gives you the right to bring it elsewhere. Either of us may bring a claim in small claims court.
18. General
If any part of these Terms can't be enforced, the rest still applies. If we don't enforce a right immediately, we haven't given it up. These Terms and our policies are the entire agreement between you and Voirelle about the Services. You may not transfer your rights under these Terms without our permission. We may transfer ours, for example if the business is sold. Headings are for convenience only.
19. Changes to these Terms
We may update these Terms from time to time. The current version is always on this page with its "Last updated" date. Changes apply to orders placed after they're posted.
